This legal action stems from the use of the name “Jo Malone” in product descriptions and packaging for fragrances sold by Zara. The US-based company claims that this usage violates a contract, infringes on trademarks, and constitutes “passing off,” which could mislead consumers into believing the products are connected to another business.

Background of the Sale and Non-Compete Clause

Jo Malone, who is 62 years old, originally sold her perfume empire to Estee Lauder for millions in 1999. However, she has since described this decision as “the worst decision of my life.” According to her, the agreement included a non-compete clause that prevented her from using her name for commercial purposes and restricted her from working in the industry for several years.

After the expiration of the non-compete clause in 2011, Malone launched her own business, Jo Loves. The brand offers perfumes priced at £35 and entered into a collaboration with Zara in 2019. This partnership has now become the focal point of the ongoing legal battle.

Zara’s Defense in the Legal Case

In response to the lawsuit, Inditex, the Spanish fashion giant that owns Zara, has submitted legal documents stating that there has been no breach of contract. The company argues that Jo Malone retains the right to use her name in a personal capacity, including as a description or to identify herself.

Zara also asserts that there is “no material risk of confusion” between its products and those of Jo Malone London. Jo Malone’s Response to the Legal Action

Jo Malone, who resides in Dubai, addressed the legal action in a video posted on her Instagram. In the video, she emphasized that seven years ago, Zara approached her directly as an individual, not as a company or brand. She stressed that she and Zara have gone above and beyond to ensure that the public understands the distinction between her and Jo Malone London.

Malone clarified that she sold a company, not herself, and that the collections were created by her as an individual. She maintains that her use of the name “Jo Malone” is entirely legitimate and does not infringe on any rights.
