The behind-closed-doors grand jury hearing, which reportedly aimed to secure indictments against Kelly, Michigan Senator Elissa Slotkin, and four other Democratic representatives – Jason Crow, Maggie Goodlander, Chrissy Houlahan, and Chris Deluzio – ultimately declined to proceed. These lawmakers, all of whom have prior military or intelligence agency service, had featured in a video encouraging service members to adhere to established military protocols and to reject any orders they deemed unlawful.

Senator Kelly expressed his outrage on the social media platform X, stating, “It wasn’t enough for Pete Hegseth to censure me and threaten to demote me, now it appears they tried to have me charged with a crime — all because of something I said that they didn’t like. That’s not the way things work in America.” He further elaborated on his sentiment, asserting, “Donald Trump wants every American to be too scared to speak out against him. The most patriotic thing any of us can do is not back down.”

A Politicised Investigation Unravels

The investigation, reportedly initiated at the urging of U.S. Attorney Jeanine Pirro, was spearheaded by the Department of Justice (DOJ). Prosecutors had reportedly attempted to convince the civilian members of the grand jury that the lawmakers had contravened a law prohibiting interference with “the loyalty, morale or discipline of the U.S. armed forces.”

Senator Elissa Slotkin, in a detailed statement, highlighted the significance of the grand jury’s decision. “Today, it was a grand jury of anonymous American citizens who upheld the rule of law and determined this case should not proceed. Hopefully, this ends this politicised investigation for good,” she wrote.

However, Slotkin also expressed her deep concern about the broader implications of such actions. “But today wasn’t just an embarrassing day for the Administration. It was another sad day for our country,” she stated. “Because whether or not Pirro succeeded is not the point. It’s that President Trump continues to weaponize our justice system against his perceived enemies. It’s the kind of thing you see in a foreign country, not in the United States we know and love.”

Echoing these sentiments, Representative Jason Crow, a former Army Ranger, declared, “Donald Trump’s DOJ just tried—and failed—to indict me in front of a grand jury. We will continue to fight back against their rising tyranny. Don’t Give Up the Ship.”

Broader Concerns About Justice System Weaponisation

The refusal of the grand jury to indict marks a significant rebuke to the prosecution, and comes amidst a backdrop of broader concerns about the potential weaponisation of the justice system. While Senator Adam Schiff was not directly named in the investigation, he commented on the situation, stating, “That the DOJ would even contemplate such an action demonstrates what a repressive regime is now running this country.”
